The Kariyarra Aboriginal Corporation (the KAC, ICN 8355) is a relatively new Prescribed Body Corporate (PBC), which is currently expanding its workforce to accommodate new and exciting roles to support the Kariyarra People in managing their native title rights and interests. These new roles will give great opportunities to those who wish to embrace regional opportunities and help make a difference to the lives of the Kariyarra People.

About the Kariyarra People

The Kariyarra People mainly live in the towns of Port and South Hedland, as well as neighbouring towns and communities in the Pilbara and Kimberley region including Roebourne, Karratha and Broome in the north-west of Western Australia. Kariyarra country is bound by Ngarla country to the northeast, Nyamal to the east, Palyku to the southeast, Panyjima to the south and Ngarluma to the west.

The KAC is the PBC which holds native title in trust for the Kariyarra People, who are the native title holders of the land and waters covering approximately 17,354 sq km of Australia.

The Kariyarra Determination Area is home to places of special significance to the Kariyarra People, including ceremonial and mythological sites, petroglyphs, archaeological and historic sites of significance as well as other topographic features including permanent pools, major river and estuarine systems such as the Yule and Turner Rivers and natural resources.

About the Position

The primary objective of this role is the establishment, management, monitoring and reporting of governance and compliance with applicable legislation, regulations, contracts, and agreements across all KAC and other entities. 

Other objectives include:

  • Assist with the implementation and compliance of Indigenous Land Use Agreements and CATSI Act;
  • Monitor the implementation and compliance of other land access and heritage agreements;
  • Liaise with mining companies, independent consultants, and service providers;
  • Assist in the management and coordination of Heritage and Implementation Committees, including liaising with committee members, preparation of agendas, compliance summaries and reports; and
  • Maintain governance of all the Corporations regulatory compliance including Native Title, KAC’s Rule Book, Corporate governance, Oric and the CATSI Act.

Key responsibilities and duties:

Implementation, Governance and Compliance

  • Track and record compliance actions against requirements of the Native Title Act 1993 (Cth), Corporations (Aboriginal and Torres Strait Islander) Act 2006 (Cth) (CATSI Act), Australian Charities and Not‐for‐profits Commission Act 2012 (Cth), Native Title (Prescribed Bodies Corporate) Regulations 1999 (Cth) and KAC’s Rule Book;
  • Track and record compliance actions against Comprehensive Agreements, Trust Deeds and the KAC Rule Book;
  • Monitor and act on Land Access and Future Acts notices and obligations under the Native Title Act and Service agreements (e.g., lodging objections against tenement applications, issuing draft Exploration and Land Access agreements);
  • Use systems (e.g., The Keeping Place, registers) to monitor compliance with land access and future acts processes and key agreements and report on obligations/actions;
  • Maintain positive working relationships with stakeholder counterparts on operational matters;
  • Coordinate meetings ‐as required – for key programs and projects;
  • Report regularly to the CEO on compliance, implementation, risk, and relationships.

Planning & Policy:

  • Contribute to operational planning to achieve compliance; and
  • Write and/or contribute to monitoring and evaluation reports.

Administrative & Meeting Tasks:

  • Support in the logistics associated with key meetings with agreement partners, service providers and other significant stakeholders;
  • Research and collect information/data for key meetings;
  • Attend meetings when required;
  • Maintain electronic and manual files and keeping records up to date, secure and accessible, as appropriate;
  • Adhere to compliance procedures; and
  • Support the preparation of agendas, meeting papers, writing and dissemination of minutes and agendas.

Internal & External Communications:

  • Within areas of responsibility, support the management of all incoming and outgoing communications (e.g., telephone, electronic, hard copy and in person) from/to agreement partners, relevant service providers and other significant stakeholders, ensuring it is responsive, effective, and approved by the CEO;
  • Assist with the implementation of KAC’s communications strategy; and
  • Other duties as required by the CEO.

Selection Criteria

Essential:

  • Tertiary qualification (minimum Bachelor’s degree) in Governance and Compliance, law or similar;
  • Sound knowledge of the Native Title Act 1993 (Cth), the Mining Act 1978 (WA), the Future Acts regime, Native Title Agreements, CATSI Act and other relevant legislation;
  • Experience working in the Native Title Sector, Aboriginal Heritage, Environment approvals or in a related role within a mining company or government sector;
  • High level interpersonal skills with the ability to establish and maintain positive and productive relationships with principal contacts and colleagues;
  • Experience in monitoring compliance of agreements;
  • Experience managing information systems (e.g., databases) to maintain records and generate reports;
  • High level organisational skills and ability to consistently follow‐through in a busy workplace with sometimes competing priorities, and highly transactional processes;
  • Cultural competence, especially with Aboriginal People;
  • Ability to react calmly and effectively under pressure;
  • Work as a member of a team with a shared vision;
  • Experience in use of computer software such as Microsoft Office, internet and email; and
  • A current Western Australia Driver’s Licence.

Desirable:

  • Legal and Paralegal qualifications highly regarded;
  • Skills in geographic information systems (GIS), MS Office Suite;
  • Qualification in compliance management or business administration; and
  • Experience working with Aboriginal organisations and people.

Qualifications and experience required/to be maintained:

  • Working with children check; and
  • Provide a National Police check.

Location and conditions

The role will be preferably based in the Hedland area however other locations such as Karratha or Perth will be considered. A generous salary package including housing allowances and benefits will be negotiated for the right person.
